Recieved much awaited emails today, "Card/Document Production Ordered" emails for both my wife and myself.
My PD is 05/04/2006, TSC.
08/24/10 - contacted local congressman office. They were helpful and immediately enquired about the status. Got the reply that the applications have been pre-adjudicated and a visa number will be available in September
09/01/10 - opened an SR with USCIS for myself -- didn't hear anything about it
09/08/10 - congressman's office followed up with TSC. got the reply that the file is with an office and should hear something by the end of the month or sooner.
09/15/10 - got the CPO emails/text messages. Didn't have any SLUD's before that.
I wish good luck everyone waiting for GC.

It is not popular to say so but I have this doubt too.
Currently at least there is no requirement to notify and you only need to prove you still have a similar job OFFER (not necessarily working) if and when there is an RFE.
Only good thing happened to us in last decade, as far as I can remember, is AC21 and concurrent filing.
All these immigration laws are designed to keep us indebted/bonded to the employer. They might see this as a liberating provision and try to chain us back. This may or may not happen, but just my paranoid reaction,.
Hope AC21 don't go away like labor substitution has. :(
That is naive... AC21 is not an administrative decision of USCIS... It is a law... AC21 = American Competitiveness in the 21st Century act!! It was passed by congress and the only body that can revoke it is congress.

Siva tells me that the flowers are indeed being delivered to the USCIS office. It has created quite a stir.
Of course, we do need to keep the entire campaign in perspective. It is not something that Brian Williams is going to open his evening news with. In fact, he might not cover it at all. After all, when you compare it with the immigration rallies of last year - this is miniscule.
But we did generate quite a bit of media attention with this, we did prove that the skilled, legal immigrant community can take collective action and we did prove that the decisions made by US lawmakers and the beaureaucracies end up hurting real people behind the numbers.
I think all that was worth my 30 dollars.

At least one of the big Indian outsourcers have recently done an internal audit to identify all L1s all over USA who were working under "client management". They are in the process of either sending them back to India immediately or filing H1s for them.
I heard this from one of my aquintances who was on L1 and is getting converted to H1. He was ecstatic about the new job portability that this offers him. I think it will not be an overstatement that the "bonded labor" nature of L1's enable a lot of very subtle discrimination and exploitation because both the employee and his manager knows that he has nowhere else to go. So this is a very positive step indeed.
If all the Indian companies themselves take steps to address this fraud - then that is probably the best non-disruptive solution that is there for this problem.

Can you please mention the source or any basis of 50 to 60 K applications pending before October 2003. I am interested to know this because my PD is also EB-3 (India), October 2003. Thanks.

actually it does matter, right. what happens if the dates retrogress significantly for EB2 again, because of the influx of EB3 to EB2 ports? Then EB2 folks with later priority dates will miss the boat.
But the question is whether the EB2 folks who are missing out are getting an "unfair" deal. That is debatable.
Let us assume that EB2 is going to be current in a year or even sooner than that. Given that situation, and arguing that about 500 people jumped ahead into line over you in to EB2 from EB3, still I do not foresee that their GC's will be approved before the people who are already in line, because
1) as FIFO is not being followed by USCIS, probably they are processing cases based on RD,
2) PD porting is effectively done at the time the second I-140 IS APPROVED. At I-485 stage you can only hope to PD recapture and cross your fingers after sending a no fee letter. This will surely would need additional scrutiny, hence is not a so called 'Low hanging fruit'. Even if an EB3 person wants to start his process right now, it will not be probably before a year and half to two years before he/she is ready to port, and by that time you are past the gate or significantly nearer.
so my point of view is if you look at this thing negatively, you would have a Heartburn and related health issues, but if you are positive and an optimist you would deserve what you get.

If her lawyer is quick to respond then you can keep everything ready including medicals and anytime date is retrogressed should apply immediately or the second option is apply for EAD and AP and I-485 case and go tense free and use EAD if you want to change jobs and don't worry about EB2 and EB3.
If the removal of AC21 succeeds in CIR, then forget about switching jobs.

Any decent website/article/source of info will tell you that you cannot buy a house if you are planning on staying for less than 2 years.

Here is some real advice:
Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

My husband's petition is from a reputed company, and its an L1 blanket petition... the petition approval date is somewhere in Nov. 2007... does this mean that it would take a long/short time to update in PIMS?

I sent a hand written letter to the President and CC'd it to CA IV PO BOX. and I feel a lot better after writing it.
I have also sent a personalized hand written letter to the Colorado Congressmen Ed Perlmutter. I will set up a meeting once I get a positive response or in the next few weeks, whichever is earlier.

I personally haven't seen any issues with Call quality. Infact Call quality is excellent.
I agree about taxes. This is general understanding. However with my teleblend (formerly sunrocket) the taxes were only around $2 at the same address where I stay now. With vonage its $6.32 -- I have no idea why vonage taxes are almost 3 times to teleblend for almost equal price plans at the same address?

Answering my own question. According to my lawyer if I use EAD, I can not use H1/H4 stamp in the passport for travel as it is no longer valid.

I also have the same question as bindas74. We both have our H1 stamped till July 2009, only my son does not have it stamped.
So if we don't apply for AP now and start using EAD and then travel outside of US can I still come back on my stamped H1 visa?
Any help appreciated.

The OP is great. He has created a new id to discuss L1 fraud. Will he be creating one id per issue... recapture, H1B abuse, outsourcing, backlogs?? wow!!!
Not sure why he wants his/ her identity covered up. This shows how good some of us are in trying to make noises in the dark and not doing anything about issues in hand.
In all, I still don't understand why L1Bs cannot work at Client site. I am sure that the L1 petitions specifically ask for Client site / work location. If Client site address is mentioned, the USCIS does approve the petition. If it is against law, they will not approve the petition. I know this for a fact since some of my friends are on L1.
Regarding my identity cover up... I have mentioned couple of times abt the seriouness of the situation as the other party is a multi billion dollar organisation, second please add all the reasons why ICE/USCIS/DOL provides anonymity and whitsle bowler protection to people who brings these kind of violations to their notice.
Regarding working at client site... Yes they do get approved for working at client sites BUT with the condition that they would be working directly under the suprevision of their managers and NOT the client managers (they don't qualify for consulting assignments). Also these L-1B visas are approved for working on speciality skills NOT on common technical skills (like java/.net/DBs/Prod Support etc). Next time read your friends L-1B petition carefully and you could find all these details over there.. also verify the L1 reform act of 2004 (published in this thread).
Regarding retrogression... I agree that L-1B visas are not impacting the same much and also I think if someone in L-1A LEGALLY qualifies for EB-1 there is nothing wrong in getting the GC, If we think thats not appropriate then we should bring this upto the law makers and get it rectified BUT fake EB1s should be notified to authorities.
We are fighting against a fraudulant activity by which our jobs (and hence our GCs) are jeopardized and its not a fight against fellow immigrant BUT a fight against the greed of these corporates to make money even by committing such fraudulant activities.. hope this clears the doubt.

Let me tell you I am as anxious and frustrated as you all "July 2 filers, no action yet" are. But I am thinking about it a bit calmly, rather than thinking of doing something so that I feel that I have done something (i.e. complain, write to congressman, etc.). Expressing my anger by saying they should have done this or that, does not change the situation. I believe USCIS is working, as expected, with the capability/attitude of a government worker, treating our filings (which are so important to us) just another government office paper work. Best is just to wait for another 10 days, and if nothing is heard by then, take action as per procedures.
