    Self : PD July 2002 -EB3
    Spouse : PD Feb 2006 - EB3.

    Suggested by our lawyers.
    File my I-485 with spouse as dependent,
    File my spouse's I-485 with me as dependent mentioning receipt notice of first I-485.
    File for only one set of EAD and AP docs. Doesn't matter with which.

    Filing both in July '07.
    Yes, that seems to be the safest...
    only pitfall seems to be as Pappu mentioned - when u enquire abt one case, INS may not be sure which one to respond for, as u will have 2 applications under 1 alien Number. This may hold true for adjudication also, and may delay ur case.

    If an employer has denied you work or fired you because she or he will not accept your work authorization as proof of your legal right to work in the U.S., or they only hire U.S. citizens or permanent residents, she or he is breaking the law. You need to show the employer the List of Legal Work Papers on the left. If the employer still insists on seeing a particular document, or refuses to hire you, call OSC right away.

In most cases, it is unlawful discrimination to require job applicants to have a particular citizenship status or immigration status. An employer may require U.S. citizenship or permanent residence for a particular job only when required by law, regulation, or government contract.

    FAQ:
    2. Can’t I just require that applicants have a “green card?”

    No. A “green card only” (generally used to refer to a permanent resident card) policy will almost always violate federal antidiscrimination law.

    If you are told by an employer (verbally or in writing) that they will consider only citizens or green card holders, call the OSC hotline. They may not give you the job based on some other criteria but they will not discriminate anybody else in the future.

    If you find any job posting or ad which states that they will hire only citizens or green card holders, or explicitly declines to hire somebody with EAD, post it here. If you don't wish to, maybe somebody else can make the call.

    In most cases it would be pure ignorance on the recruiter's part. A simple phone call from OSC will clear that.

    Of course the best course is to avoid bringing up EAD in the first place. But if it comes to that, you can reach out to OSC, even if you don't have anything in writing.

    gO learn the concept of supply and demand before asking a question as to why banks are lowering their appraisals!

    Yes, I do agree that we should have some sense of personal responsibility and that is why the middle way is to rent out the house (probably at a bit lower price than your monthly mortgage) and pay the difference from your pocket - if you have to absolutely move out from the house. But, can somebody answer my question above..........why is the same house (not even a brick changed) being appraised at around 100k lower than it was done 2 years back, by the same bank??

    I called the Nogales (mexico) US embassy and they were able to look up the PIMS system using the petition number.

    I hope the PIMS is a "centralized" system. So even the consulate in India would be using the same.

    R u going to Nogales or just called to inquire???

    People go by "how the wind flows" - when they just see a few of us stressing out they think they must not do anything - simply because they think wind is not blowing. Unless people believe in themselves and have the capabilities to make right choices and independent decisions, they will always be influenced by "negative flow". This is something we have always been facing in the community.

    Every member and a guest must take these efforts seriously. Make your own wise judgement and not get influenced by negative flow. The negative community can pull you down big time, they have the capacity to destroy themselves and the entire community. Laziness seems to be the major cause for the negative energy and it will be interesting if people have any other excuses

    I called today to help a friend who has been stuck in namecheck status for almost a year and a half and spoke to an immigration officer who calmly explained to me that the name check isn't done only nationally but also "internationally" meaning, not only do they do a background check on you in the US, they also look you up in your country of origin. In all my time reading about this I have never heard her version before, so I had assumed the namecheck was only done at the national level. No wonder it's taking so long, with the FBI waiting for a response from those countries. :(

Then with a copy of the letter in hand, and with your AP, seek to reenter the US on your own terms... Good luck...

    Why you are suggesting to withdraw H1-B stamping application if you have AP in hand?Because as far as I know that you can use AP to re-enter even if your H1B stamping is pending or even denied????

    How is charging different amounts for the same kind of visa and refusing to correct the mistake OP's personal responsibility ?

    Correct. We need to boycott them when they become unreasonable. A great man once moved an entire nation to do just that for a much greater purpose and it delivered results just over 60 years ago.

    In a global world, if they choose to remain racist, ignorant and unreasonable, then my $ goes elsewhere. Vote with your wallets and boycott these Brits.

    They are free or just 1 cent a minute. This is much better than Vonage.

    I personally use ActionVOIP (another Betamax company). No real big complaints so far - except for the weird feeling something that they are occasionally stealing minutes from me. It's still cheaper than trio of Teliance/Trueroots/Airtel (as evidenced by my consistently lower spending per month). Even after getting vonage - I intend to keep my account in ActionVOIP with a small amount in it just for emergencies or when away from home.

    However, in case you are planning to use any of these Betamax outfits - please keep in mind that Betamax is borderline shady. There are complaints galore about them misusing credit cards and using shady fly-by-night companies to evade responsibilities. So never ever give them your credit card number - always use paypal.

    The funniest thing is 3/4 of the countries on the list are part of the erstwhile British empire. How's that for irony. They loot and dominate you on one hand and subject you to inane laws on the other. Here is a classic example of what is good for the goose is not good for the gander.
