If revenue from increased fee structure starting July 31 is the reason for making visas unavilable in July, I have a strong feeling that the visas may become current for all categories in the Aug Bulletin.
This is not a NEWS or RUMOR making rounds anywhere. This is a mere speculation on my part. Let's hope for the best but DO NOT get your hopes unrealistically high.

I guess we'll need to ADD to that number:
1. BEC stuck folks who could not file in July 07
2. PERM approvals starting August 07
to the 47,728. Plus multiply by 2.1( for dependents ). That'll give the total VISA numbers required for this category to make it Current.
If I have to guess-- (1) would be very less, may be 100-200 max
(2) around 5000 ( just a PUMA)
So, there are about 53000 EB2 I applications. and 2.1 * 53000 = 111300.
If we can create 111300, EB2 I visas then it'll be CURRENT. easy:)

Not excatly. eb3_2004 has posted the link of INA. You will find more interesting things if you read through it.
Non-descrimination rule is clearly spelled out in Section 202 (a). I assume this rule should be generally applied to all applicants, no matter which categories they are falling, unless other rules specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203.
INA does not say to spillover unused visas first to EB2 then EB3. I assume USCIS and Department of State should treat each EB applicants equally (based on their priority dates, not based on EB categories) in according to INA act.
It is likely the misinterpretation violates the law. We need some one which more professional knowledge to read through it. Can some core member help?

i received reply to my inquiry email from mumbai consulate. and they wrote following in email
"Please wait till you get an email from us.

I also visited the inquiry window at mumbai consulate personally and here is the coversation I had..
me: I had my H1b visa interview on feb 11 and I want to know the status of my visa.
she: what is your name (did something on computer). it is still pending for verification
me: how long will it take?
she: it might take another 1 or 2 weeks
me: i was initially told that it will take only 1 week and it is already more than 2 weeks.
she: it takes time
me: what is the procedure to withdraw my visa application
she: if you withdraw, how will you go there?
me: i have advance parole document with me
she: it is advisable to wait for this visa. if you go on advance parole, you might be inquired at port of entry.
me: i have to find some other option as my client is waiting there.
she: if you want to withdraw, you can send an email or you can come here personally but it is advisable to wait for this visa (she said it again).
me: (i again asked) so i can withdraw and then go back using advance parole?
she: as I said, it is advisable that you wait for visa

In I-485, when we enter I-94 information, I am not sure which date to use in the valid field.
The date on my white EAD card expired already. I have a new I-797 which is valid until 2010. My guess is I should enter this date. Can any one please confirm?

If you take 1st line you want to write two names in it, that would create a confusion.
If I fill up another applicaiton for derivative, I have to fill up the same way as I filled for myself right? then I will go for this option.
No you can number the names. Put 1 - and write the details with 1 labeled near everything. Same with 2. I leave it to you. If you want to fill two forms to avoid confusion, please do so.

tracker site data is fake....... tracker site has employees sitting in India...... those employees create fake ids and fake profiles....... then they write post using those fake ids to create an impression that there are lot of people posting on the tracker site...... if you look at title of most threads...... they are framed in the manner that will be inviting most others to write on the thread.......... every few days these employees sitting in India..... using a fake profile ........ start a new thread with a title something like .... 'i got it i got it ' or ' i am green' or something similar..... and using other fake ids the same bunch of employees ask fake questions from op..... who is also a fake handle...... so the data there is totally fake..... that data represents the need of the tracker site to make people to come to their site...... that data does not represent the sample data...... not even close.....

When I filed my I-485, the letter/job offer of my employer stated that the job will be open for me as soon as I get my green card. So when I get my EAD in 3 months, what am I going to do with it if I will not be working for my employer yet.
This is because the "green card" (GC) is based upon a future job offer. The person is not required to have worked for the GC-sponsoring employer prior to filing or obtaining the GC.

of July 2nd 2007, USCIS announced that EB visa numbers were not available
and all petitions filed in July would be rejected.
For the legal skilled immigrants this has been a rather traumatizing and
disheartening experience. These are people that are in the country

NSC has approximately 26,000 I485 applications that may have a visa available and we are reviewing them as expeditiously as possible. This application is in line to be worked but it will take time. Please allow an additional 45 days for NSC to adjudicate the application. If you have not received a notice from NSC after 45 days you may submit another inquiry.

It's almost approx 75 days since the application received at USCIS and have not received the Receipt Notice or any notification from USCIS.
I tried to contact Customer Service at USCIS. They don't provided any information. USCIS website updates show they are processing 08/01 or later for AOS application. They are not following the First In First Out(FIFO) order.
I need help of your good to know the status of my I-485 application.

I hate to play "who winks first" game with teleblend. They told that they would come up with similar india plan but not providing any details.
May be now I should switch to vonage or Lingo. One factor in favor of vonage is: I get two months free with referral and one year contract rather than 2 years with Lingo.
As per one my close friend, lingo CS is not very good. Vonage is still better than Lingo.
However here is my question.
The acutal cost of Vonage with unlimited india calling is $31 - $32 per month due to taxes, misc charges etc.

I checked with USCIS by calling them and they still have no records for me in the system. They admitted that there are many who have not been entered and issued receipts even though the dates at NSC & TSC shows otherwise.
Adviced to be patient and call back in October 1st week. According to them its still not long enough for them to launch an inquiry to find these July 2nd applications.
My lawyer also says she can't do anything yet unless they say that they have filed everything they have received.
Again what a mess ...waiting for reciepts takes so long wonder when they will finally process the GC.
I know many 2nd July filers who have even received EADs.
I hope our patience pays off and they rewsrd it with giving the GC straightaway;).....wishful thinking.....

There is another thread on the issue and some of us think that we do have a case. Initial response from a certain lawyer has been positive.

The affected parties (i.e. us) need to show damage in certain way and I do have some points that can be used.
Any lawyer will tell you that you have a case because he wants to make more money. Its like going to Walmart and Walmart telling you that the product does provide value for your family. You take any case to any lawyer, 99.9% lawyers will tell you that you have a case. You go with an idea that you should be the President of the country, they will tell you "Ya I can clearly see why you feel like that and I totally agree, so you may have a case there". My suggestion is, please do not waste your money if some lawyer is saying you that "you have a case". They know that is what you - the potential client, wants to hear.
Our primary point is that the spirit of law has not been upheld.
I bet this is what your lawyer told you. Do you realize how vague this term "spirit of the law" is. But, as long as you are ok to put you money in fire, who cares. Go right ahead, knock yourself, I am right behind you and best of luck, you sure need a lot of it. :p

Thought this was stupid idea about couple of years back, looks like its not that bad! Every one likes it and wants it!
