I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..

I recieved 2 notices in mail today.
One is the welcome notices which says that I-485 is approved.
Another notice which says that they reviewing or reconsidering the decision previously taken.
Called 1-800 # and the infopass. They say that reopened or reconsidering the case as the visa numbers retrogressed.
How can that be when am current in oct as well.
Mine is EB2 and the priority date is Dec 2004.
Any suggestions to have this fixed.

What if the USCIS suddenly realized that they can make more money in August due to the fee change? So someone in dept had a brainwave thinking - why not move back the dates in July and move forward again for the August bulletin??

Amicus brief filed in the 1st Circuit appeal by AILF.
The brief discusses in details three major questions:
1) why the USCIS has a duty to adjudicate any application properly filed with them
2) why 8 USC 1252(a)(2)(B)(ii) does not bar jurisdiction in AOS mandamus cases
3) why the duty to adjudicate does not depend on a specific statutory or regulatory timeframe.

Let us talk about the "skills" introduced by H1/L1/offshore companies
a) One guy takes the phone interview for 15 other guys with "skills" they preted to have
b) Lying on the resume with "skills" that you don't have, so that you can learn the "skill" at the expense of the client
c) "Skill" in Violating B1 visa laws and sending people on B1 to do actual work to client
d) "Skill" in violating L1 law which is used to drive down the wages by 20-30%
e) "Skill" demonstrated by indian offshorers to enter into a contract with a large corporation where they will provide warm bodies in exchange for a very low billing rate. Client wouldn't have any ability to interview the incoming cosultant, which means the offshorer employee is learning at the expense of the foolish client. Then that will be touted as "savings".
f) "Skill" of fly-by-night operators to shave off 70% of the billing rate through a 6-level pyramid of contracting companies

Hey Hunter, were you born in this world with C++ knowledge baby? I have said to some of my managers and also clients that I was interested in the job because I wanted to ramp up skills in that area and they were more than willing to give me that job.
And let me guess, you are someone who hates Indians, isnt it, so why dont you spend some time upgrading your skills , will help you in your own personal skills and career? Rather than waste time on this board.

Taking the Emirates or Kuwait airlines is another option. They have flights that doesn't need transit visa. Service quality ? better than Air India !

I agree that we have many silent well wishers and this is our last chance though we have oppositions by Number USA and Programmers guidl but colletively we are more strong then them

The L1 visas done by the outsourcing companies are the main reason for the employment problem. These companies like TCS, Wipro etc.. bring people in L1A, L1B blamket visas to do the common development/Business Analysis/Project Management job in the client site.
There is no quota for L1 Visas. They can bring any # of people they want. Per law the L1A s should be of senior managerial position with at least 4 subordinates working under them in US and L1B should be of specific skill very important for the project and not available in US. But the most of the L1As from these companies are just programmers/BAsor small PMs. They are directly controlled by their client manager.
The main intent of these our sourcing companies is to send the employees on L1 and the employees are constantly told to somehow transfer the project to offshore.
The L1 frauds should defenitely be reported. I totally support this initiative to report the L1 frauds committed by these outrsourcing companies.

Wife as Dependent -
Case 5
Wife files as Primary - 485 assuming she has 140, or if not 140 + 485
Husband is not a dependent.
If Case 4 is approved then both are safe (if Hub as a better PD).
If Case 5 is current - Husband can do follow to join and get the GC

I think we going to get 8k from EB5 , 12k + from EB1 and what u think for EB2 ROW ? last year EB2 Total = 53 k - EB2 IC (25k) = 27-28k EB2 while they supposed to get 35-36k.means spill from EB2 row was 8k-10k. EB1 gave 1-2 k.
if we get same from EB2 row and Eb5 then total spill will be 8 (EB2 row ) + 8 (Eb5 ) + 2 (Eb1) + 12 (Eb1 ) = 30k. Demand upto July 2007 is 32k - 33k... so more chances of June 2007. if we get more from EB1 and Eb2 row then chnaces for july aug 2007 are more and more...

I tried calling KCC and they denied to provide any information on PIMS.

I have an employment-based petition and I'm presently unemployed. From what I understand, the sponsoring employer can hire me when I get my green card. So, when I get my EAD, which is most probably in 3 months, can I use it to work for whomever I wish?
If an employer files for your green card and you do not work for the employer, it is considered a visa fraud. Also, you have to wait for 180 days after applying for I-485 to be eligible to work for an employer other than the one who filed your labor.
Since you are in the country illegally, it would probably be faster for you to get permanent residency if the new immigration bill passes.
