Its been over 3 hours now that I informed CapitalOne that the discrimination is illegal. And as expected, no reply received yet.

Thank you for the reply.
I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.
Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?

My appointment was on the 12-Dec. Visa was approved immediatly - was told I'll get it in 7 days - but haven't received the passport yet 56 days to date. I receive the same response when I call.. that its under PIMS verification. No ETA of when I can expect it to be done..

JSB ! You are just one very optimistic one.. aren't you ? :)
Let me tell you I am as anxious and frustrated as you all "July 2 filers, no action yet" are. But I am thinking about it a bit calmly, rather than thinking of doing something so that I feel that I have done something (i.e. complain, write to congressman, etc.). Expressing my anger by saying they should have done this or that, does not change the situation. I believe USCIS is working, as expected, with the capability/attitude of a government worker, treating our filings (which are so important to us) just another government office paper work. Best is just to wait for another 10 days, and if nothing is heard by then, take action as per procedures.

My PD will be current in June 2007.
My 485 was filled in June 2004 and I got married in Dec 2004. NOw I need to file I-485 for my wife. I have couple of questions.Any help is welcome.
1. Can I file her I-485 without medical/Immunization?
2. What will happen if my GC is approved before we can file her papers?

I called FBI yesterday and asked for FP results. I was told they sent it to uscis and I saw LUD. Question is:
1) Does finger-printing & name check go together?
2) When FBI sends it to uscis does it mean nc/fp cleared?.
Any thoughts on this?

I know that is ACT. But USCIS can interpret the provisions and make adjustments like what we are requesting. Similarly it can , IF THEY WANT TO, include a provision saying the job not only need to be in similar field, but it shall be in the same labor market because that is where you got your labor. I am not saying this is going to happen just because IVs effort.
If the intent of the similar job requirement is not to hurt the local talent because that is that job that is advertised for, the restriction of the same labor market will serve the same purpose.
That is a legitimate doubt and concern for some.
Chandu, I have great respect for your enthusiasm , but why do you have to be so hostile to a person that does not seem to think the way you are thinking. Different people react differently for the same news. I am not sure your rant has any back ground with any other post by the people you are pissed off about ;)
And the above answers concerns some may have and shuts them up. Shouting at them definitely will not help any body's cause. What has getting a GC to do with how you raise your children ?
Since when this immigration is a BIG issue in USA...... remember the BIG Rally ?? Some of the efforts with positive intentions may have a negative consequences in the short term or a long term.
The reason I post those strong words is because negative posters seem to influence people's decisions a lot. An example is , right during the rally time, I had negative people calling my wife and frightening her about the rally. She was always confused, and did not understand if she wants to support me for my efforts on mobilization or listen to them. It took a while for us to overcome her confusion. Negative posts and negative influence impact and hinder our efforts a lot. We do not need anti immigrants to cause damage, these negative posters do more damage than anti immigrants. One negaitve post can influence many people, as such it is very difficult to draw people for a good cause these days, people just do not want to cooperate or just are not motivated, negative posters demotivate the fence sitters.
If people are positive and cooperative they influence positively, they set an example for others to follow and that is what all the positive folks do, no matter what the negative influencers say or do, positive people always remain positive and try to guide people through examples.
"needhelp" is a good example of positive motivation - she does everything she can to set an example - if people learn from her - that is what we want

What are the emails you got? I didn't get any email on I-485 approval. Update me if you get any other correspondence. I will update too.

Lou Dobbs and CNN runs an hour long "Hate Immigrants" Program every night Monday to Friday. He repeatedly calls US immigration as a failed system, H1-B and L1...as cheap labor and stealing American jobs, he has big problem with China and China's developing economy, He blames foreigners for bad economic condition of California. He proudly uses the word "Illegal Alien". His program "Lou Dobbs Tonight" is nothing less that someone in Iran running a hate show against America. Lou Dobb always called CIR as "So Called Grand Amnesy"! Once this July visa bulletin fiasco settles down, we need to get together and attack this guy, every night so that he can stop his hate propoganda.

Setting aside moral and ethical arguments: three of your five suggestions are plain wrong, financially speaking:
taking new credit cards, buying a new car, renting an apartment. Interest rates are not locked and do you know, financial institutions can close your account and ask for the balance ? renters run credit report every time you extend your lease and can kick the renter out. These transactions may seem seamless for a person with decent credit but are extremely damaging for a person with very poor credit.
Leo2606, Being ethical is not a fancy word in business, in the long run (I am not talking about decades) your partners, customers and lenders will know about your practices and run away. Ethics and Morals are not something you take lightly especially when you are running your own business.
Take time to read some of the references listed here

�You, see, they�re Indian Crabs - if one tries to climb out, the others will pull it back in, hence there�s no need for a lid�
Concentrate on action items and work harder than ever, which can bring a great relief to entire EB community. It does not matter how many times we failed or succeeded, every attempt we are an inch closer to our ultimate (IV) goal.
