this is the email came from my lawyer today..for the inquiry they did with the consulate regarding my visa.

The stated reason for the review falls within the law under Section 221(g) of the Immigration and Nationality Act. Under these circumstances, we typically see that the government issues a notice to the applicant wherein additional information is often requested. Kindly advise if you have received any notification from the consulate on this issue.

I am sorry and can understand how frustrating this would be for you. But you keep your spirits high. Can you ask your lawyer to contact DOS himself and inquire about your case? Once he has some information, he can communicate with the consulate here in India directly. I am not sure if you can do much here. I am wondering if there is anyway for you to contact VO instead of VFS ppl.
But importantly dont get discouraged, you will sail through.

Looks like this year USCIS understood they need some money and accept some extra applications, which may be the same file I485 when PD is not current. and date might go to end of 2007.
Just a thought
If it is for applications money, they might as well make it current.
There are not many applications between Jan2008 and jan2011

Saralayar, if you create a new thread with main topic as action to Vote on Change.gov, it may get more attention, and IV members can also send that link to their GC holder friends.
As per the following link, it seems they have wraped up the briefing book from change.gov to present it to the President. Now we (Core IV) need to take this idea and include in all their activities along with the GC issues. Why should we leave this?. Let us try. If we get, it is GREAT...

Guys - please use referrals - it gives 2 months free to both the referrer and the referred customer. So find your favourite "already Vonage customer" - and have him refer you. The referral takes about a day to actually arive.

If anyone thinks that this does not affect me because my ex employer won't revoke 140 or I am having US masters or I work for best company or I have unique skills and whatever you think , you are making a big mistake by taking this issue for granted.

So, potentially anyone can be a victim.

We could also do a signature/petition campaign that would focus on 'American Citizens' supporting our effort. We should aim at getting a lot of signatures. Afterall there have to be hundreds of thousands of formerly H1B holders who are citizens now; at least they would support our effort.

can you please let everyone know when was your H1 approved? (that will help decide the pattern for passport delay due to PIMS..)
My H1 extension and transfer to a new employer was approved around Feb 2007 and validity is between mar 2007 and feb 2010.
So did you guys notice a pattern here ?

My flowers from FTD got shipped through DHL. Are they going to stop the DHS guy and ask him to go to the Hospital????

Called one more time using the POJ method to NSC... This was probably the most fruitful call to NSC in the last 7-8 odd times i have called them.
Someone called Terry answered the call... Hats off to this lady...If there is a way i would want to recommend this lady for a promotion and make her the project manager for all the rest of the IOs who answer the call!!!
My case PD is 1/15/05, filed at TSC, transferred to NSC in Mar 08, applied AC 21 in Aug 08 and did biometrics in Feb 09.
Information i received on my case from this call:
1. This lady got my receipt#, checked details and history on my case, let me know that the case is preadjudicated (she defined preadjudication before that)
2. and then, told me that the case is NOT in storage area.
3. She mentioned that preadjudicated cases are held in an area called exams area and my case is currently on its way from exams area back to the officer who had preadjudicated my case earlier in Oct 2008.
4. She then checked my wife's file to see if that is also with my case just to make sure that file is not lost etc and confirmed that both files are together.
5. She also mentioned that nothing else needs to be done right now for my case as it is already on its way back to IO.
Thanks to know that there is atleast one person at NSC who understands what we are going thru' and is willing to atleast provide some details...

However, what she told you, you probably already knew. Her understanding of your situation is what made you feel good about the call. IN the end however, t is competence that matters. When the USCIS says FIFO and there are over 4 yr old 485 cases in the queue, you quickly realize that incompetence abounds.
Lets not confuse sympathy with competence.

Well if you look at the big picture, assume the data is complete, about 233,000 total pending EB apps. Forget about the country, category, etc. for a minute.
New apps are coming in if PD current in monthly Visa Bulletin. If you get a velocity of these news apps by month/year then this becomes kid level math, given that 140,000 gets approved each year, don't know if that's a fact though.
So are there 100,000 new EB apps a year? or 50,000? Something else? That's Visa Bulletin dependent though.

There is no ambiguity in law. The law is clear. One law (and one rule) should yield one interpretation. If someone interperting the languge of law differently; then that is their mistake. Thats what DOS was doing in between 2001 and 2006.
The law comes actually down to the following two rules:
(1) horizontal spill if visas available
(2) vertical spill for visas not required
The language in (2) is much stronger. A visa number that is still available cannot be required at the same time. So one could argue that DOS is now misinterpreting the law.

Finally, we got the approval emails for self & wife.
I had got an email from TSC.Ncscfollowup@dhs.gov last friday (09/17/2010) with the update below-
1: The review was complete
2: Visa numbers were requested 2 months ago and all security/prints are current
3: Files have been forwarded to officers for completion.
In my case the email to SCOPSSCATA@dhs.gov helped a lot. They in turn sent an email to TSC.Ncscfollowup@dhs.gov to step up the processing.
As others have mentioned IV has played a big part throughout this journey. Thank you again.

Example, EB-1 china number goto EB-2 China ? I thought all EB-1 China numbers are added to the excess pool and then given to most retrogressed EB2 category ?

boreal, cool down. Just think what you will do if you are in that situation.
At personal level ( micro level) these people are making right decisions. As long as you are not committing crime, nothing wrong with making decisions which are good for you. I will probably do the same thing if I am in that situation.
The core problem with system was cheap money because of lax lending standard and low interest rates ( blame Greenspan) and affordable housing (like ACORN from Dems). These decisions are made by people in power and so called smart people. Individuals do have their contribution to the problem but the macro decisions provided them means to have things which they can not afford. The bubble had to burst sooner or later ....
So right now, remember wealth is always relative. So since you haven't bought house, you don't have negative equity or declining value home.You haven't foreclosed so you can still get loan at decent rate and buy house at much cheaper price. All the people with money in the market are affected by recent downturn. So relatively speaking you are doing much better than a lot of other people ....
BTW I am in the same situation as you are and waiting for good opportunity to buy house at cheap price. Do you see the positive side ? I hope you do .....
People like you and boreal are doing much better because you decided that a 2 bed room house for rent is what you can afford because the prices shot up by guys like punjabi who wanted to make money and overbid on an house they cannot afford. Otherwise guys like you and many others would have bought house at a resonable price.
Don't you see what is happening? They live a rich man's life buying house that they cannot afford and then they foreclose with banks taking the hit. The banks in turn gets money from Governement, which they tax on people like you and many others who are renting, so that the guys like pubjabi are entitled to big house and bailouts. This is sick. Where is my bail out money. I want my rent to be subsidized too. I think boreal 's anger is real.
