    As I've mentioned in Rolling_Flood's thread, this issue has some merit and needs to be discussed. My personal take on this is that if you were eligible for an EB2 position at the time of filing the EB3 petition, you should be allowed to interfile.

    I'm probably not going to participate in the lawsuit because I don't want to divide an already weakened community. Neither will I try to stop it because I think it raises some valid questions.

    I personally think that IV needs to make some changes and the first step would be to stop quoting figures like "we have 25K members" when the reality is that hardly 200 people participate in the call campaigns and it was due to random strangers that we were able to collect 5000 signatures for the administrative fixes. Most people come to IV to get some easy answers or to pass time by playing some games like the visa bulletin predictions game or the identify the TSC approval pattern game, etc. Only the core is working relentlessly for us besides a handful of volunteers. I think that there are enough agony aunts for immigration issues and IV should be exclusively for immigration related lobbying and legislation. It's the only way we can get rid of the 25K - 200 people who do nothing and then focus on the real issues.

    Air India flying direct to India starting from feb 08, at least that's what I was told when I went through that horryifing experience in UK (see my post above)
    Air India has been flying direct non stop to india from NYC area for quite some time now.......

    and i was recently in seattle - driving by boeing facility (its actually right by the main freeway)- saw quite a few brand new planes with Air India and Jet signage.......so help is on the way :-)

    also - am shocked that people still use travel agents - when all major airlines scream at the top of their voices that their lowest fares are online.....

    i have flown non stop from NYC area at all times of the year and also have bought tickets for my parents from delhi-newark and return - all on continental.com and have never paid more than $1100 per person ...(sometimes even around 850) plus if you use the right kind of credit card online - you can recover almost 10% of the cost via rewards points.

    FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

    What you heard is probably true, I was a customer long time back and wanted to disconnect, on top of stern response and attitude, they charged me for the whole month instead of prorating it .
    I like the new plan , may be I might buy it but if vonage has done this there will tons of other companies who will slash the prices or atleast match vonage.
    The world wide calling if great if you are calling your home country everyday or the phone card companies are costing you more than $25/month(air tel and others). Besides $25/per month these days is ridiculous(before the free worldwide calling plan). You can get a GOOD VOIP service for $10 or even under that these days. Just good "voip service providers"
    Bottom line- Great plan by not so great cust serv company

    I received I-485 approval letter from USCIS today which reads as follows:

    "The above application has been approved. Prior to receiving your permanent resident card you may be required to report for biometrics processing (photo/fingerprint/signature). Please do not take any action at this time. If you are required to report for this processing, you will receive another notice advising you of the date, time and location to appear.

    If you have not received your permanent resident card or the above mentioned notice to appear for biometrics processing within 90 days, please call this office at the number listed above."

    Did anyone receive a notice like this? How many days did it take to get the biometric notice after this notice if anyone received the above?

    My wife already received her physical green card although she is beneficary of my application.

    I was planning on going to India in Nov, but can't book now as I don't know how long it will take :mad:

    I don't think InfoPass will entertain me to request for Biometrics especially since this notice tells to wait.

    Anyone with similar notice, any inputs are greatly appreciated. Thank you friends!!

    I'm not blind to stereotyping in this forum or elsewhere. It's not you vs. them kinda thing. You ARE stereotyping based upon some TRUE things but it is still stereotyping, isn't it.

    Also, you understood some of my comments wrong. All I was saying is that due to big ISV's like TCS/INFY/WIPRO and mushrooms of bodyshops the actual worker gets pennies on a dollar and they keep the booty. So it's not the worker who causes wage depression it's the circumvention of the spirit of law that these companies do which causes it. I say "spirit of law" because they still stay within the legal framework. As far as offshoring is concerned it's a big discussion in itself and forces of capitalism and globalization are at work. None of us can prevent that but we can counter it by moving up in the value chain.

    The scenario you described about modus operandi of big Indian ISV's is 100% correct but to generally imply that Indians are 1/5th as good as Americans when it comes to IT (50 member team vs. 10-12 member team) is a supremacist attitude and completely untrue.
    It is true that the Indian counterparts are usually of much younger age but rarely substandard for the job. Companies realize that IT is no-longer considered rocket-science and they can save a few bucks. Try to think objectively keeping personal impact aside.

    Now regarding overall economic input of immigrants there are issues broader and larger than you mentioned. Some of the smaller points you mentioned are true but you are completely missing the big picture. We can discuss that in a different thread :)

    When Bill Gates says best-and-brightest it applies to individuals and not a VISA category, he's not lying. Among the 65K every year you'll find people from all skill levels, cream-of-the-cream to just-about-ok, and a few rotten-apples too. The immigration system is not designed to test skill level. Overall it's old, irrelevant and doesn't help anyone. It needs to be re-designed but unfortunately people are divided on fake lines and ignore the real issues or rather real solutions.

    Although you have said it differently but you are right that solution to mine and your problems lie at the same spot, a modern, common-sense, immigration system that promotes best-and-the-brightest (Indian and American) and discourages exploitation.

    I know most of the ppl file EAD and AP along with I-485, but is it possible to file EAD and AP at a later time and not with I-485.

    I know it's a stupid idea but just curious whether we can do that or not?
    Also is the filing of EAD and AP also ties with your PD being current ?

    Friends we all know to get AC21 it takes 6 months from the date of 485/EAD application.

    Suppose you get your EAD and say have an extension on H1B also for 3 years. But you have not completed 6 months after date of 485 application. In the mean time you loose your Job, then can we still retain the EAD... with say new employer....

    Yes, the old system will be restored. Please note that this is the only sure fire way of EB3-I going forward. There is some comments that EB3-I can really only benefit if EB2-I goes current with the current horizontal spill over rules. Such statements are clearly misleading. Eb3-I will not directly be impacted by EB2-I being current. It just allows EB3 to get a lot of numbers which will first be used by EB3-ROW before spilling over into EB3-I.


    With this change, we get EB3ROW move ahead faster, it probably would have been C had the rules been followed, and EB3 would have started moving ahead.

    The only way for EB3 to move ahead is for EB3-ROW to become current, nothing else will help EB3 beyond the visa recapture (which is iffy at best). If we get USCIS to follow rules, this happens sooner, and EB3-I starts to move sooner. If not, EB3-I shall wait for a long time.

    This is the only reason am not taking vonage.

    When we want to discontinue service, its very difficult to get a CSR to perform this activity. It may take an hour or 2 after looong waiting periods. I heard even wrong charges in the final closing statement.

    Please answer this and lot of people will join based on your response.

    You must be kidding me if you cannot make out the difference between an approval and an RFE. It clearly states "Your Case Status: Decision"... What more do you want?

    I was wondering why the status went backwards (from CPO to Decision) and if that that is a normal process.

    I do understand that without evidence you can't fight the conventional way or file a law suit. It would be difficult, if not impossible. I am not debating that. I never said it would be easy. Even with evidence (in case of Capital One), one can argue if thats a good enough base for fighting and whether it will do any good if the case is won. Thats not the point.

    What would you do if a recruiter or employer told you (verbal or writing) that it is their policy not to hire Indians? (I am just using India as an example).

    Regardless of written evidence, I would be inclined to do something about it. I am not saying that I will file a law suit. I would probably not even want to work for such an employer. But I will not be speculating that oh, there must be some loophole that allows employers to have such a policy; because many of them are saying that, it must be legal. I will not assume that they can do this under "Hire and fire" authority. We just seem to have a little difference in opinion about that. We agree on pretty much everything else. Thats all. And frankly, its good to have an opposing perspective on things.

    Now, if I hear from experts that my understanding of the discrimination laws is incorrect and that it is legal for an employer to say that they will not hire somebody with EAD, I'll just shut up. Until then, I will encourage people not to be quiet and to call the hotline, file a complaint, call the media, and pursue whatever means we have at our disposal to fight what we consider injustice and fight what we believe is discrimination as per the law.
